If you are booking on behalf of a group, these Terms apply to all members of your group.
1.3 Acceptance: By using the Site or placing a booking with Lagunea, you acknowledge and agree to these Terms in full. No alteration to these Terms shall be effective unless expressly agreed to in writing by an authorized representative of Lagunea.
1.4 Legal Capacity: By using the Site, you represent that you are of legal age to form a binding contract and possess the authority to create a legal obligation on behalf of yourself or those you represent.

4.3 Multiple Participants: In a booking with more than one participant, the person making the booking is the primary point of contact. All communication regarding the booking will be directed to that person.
5.1 Advance Booking: To ensure your preferred date and service, we recommend placing your order at least 20 days prior to your travel date. All bookings are subject to availability.
5.2 Confirmation: Lagunea does not display live availability on the Site; all bookings will be confirmed by our customer service team. If you book an activity without confirming availability and it is unavailable on your selected date, you may be subject to a 5% cancellation fee for processing and handling costs.
5.3 Special Needs: Any disabilities or special needs must be reported at the time of booking. Lagunea will attempt to accommodate such needs but cannot guarantee that all vendor services are fully accessible.
5.4 Group Bookings: For group bookings (2 or more persons), the lead customer is responsible for ensuring all participants are aware of and agree to these Terms.
6.1 Secure Online Payment: Lagunea uses a secure online payment system (e.g., “MasterCard” payment gateway). Bookings can only be made with a valid credit card unless otherwise agreed.
6.2 Data Protection: Credit card information is neither accessible to Lagunea nor stored by Lagunea. It is processed by the secure payment gateway.
6.3 Order Validation: Your booking is considered valid only after payment approval. If payment is not approved, the booking is automatically canceled.

9.2 Force Majeure: Neither Lagunea nor the vendor shall be liable for delays or failures to provide services due to causes beyond their reasonable control, including but not limited to war, terrorist activity, civil unrest, industrial disputes, acts of God, natural or nuclear disaster, technical or maintenance problems, and adverse weather. In such events, Lagunea or the vendor may cancel scheduled tours, attractions, or activities without notice.
9.3 Right to Refuse Admission: Lagunea and/or vendors reserve the right to refuse admission or services to any person at their sole discretion, including for inappropriate or dangerous behavior.
10.1 Open Voucher: An open voucher is valid for a specific product or service and is valid for 3 months from the date of purchase. The voucher must be used (i.e., the activity must commence) within this 3-month period.
10.2 Expiry & Extension: If you do not use the voucher within 3 months, it expires with no refund or compensation. If you wish to extend it before its expiration, a 20% supplement on the original amount may apply.
10.3 Booking with Open Voucher: You should request your preferred date at least 10-12 working days in advance. Late requests (less than 10 days) are not guaranteed.
10.4 Refund During Validity: If you request a refund within the voucher’s 3-month validity, a 20% fee of the total voucher amount applies. After expiration, no refund is possible unless you pay the 20% retrieval fee.
11.1 Medical Advice: Lagunea and its agents are not medical experts. You are solely responsible for determining your fitness to participate in an activity.
11.2 Limitations: Some activities may be unsuitable for individuals with mobility issues, physical or cognitive disabilities, weight restrictions, or other medical conditions.
11.3 No Liability for Unfitness: If you cannot participate or complete an activity due to physical or medical reasons, Lagunea is not liable for any costs or damages incurred.
12.1 Immediate Notification: If you experience any issue with a service, you must notify the vendor immediately so corrective action can be taken.
12.2 Written Complaint: If unresolved, you must write to Lagunea within 28 days of the activity date, providing your booking reference and full details of the issue.
12.3 Failure to Comply: Failure to follow this complaints procedure may affect your right to claim compensation.
13.1 No Liability: Lagunea is not liable for damage to or theft of personal belongings during any activity.
13.2 Personal Responsibility: You are responsible for the safety of your own belongings. We recommend not bringing valuables or, if necessary, keeping them secured.
14.1 Conduct: You must behave responsibly and respect the rights of others. Vendors have the right to terminate services if your behavior is deemed dangerous, disruptive, or offensive.
14.2 Damage Liability: You are responsible for any damage you or your group cause to property or equipment. You must indemnify Lagunea and its vendors for all claims arising from such damage.
14.3 Waivers: Certain activities may require you to sign a waiver. Refusal to sign may result in being excluded from the activity without compensation.
15.1 Non-Refundable: Tickets for events (including performances, shows, or festivals) cannot be canceled, rescheduled, or modified.
15.2 Venue or Cast Changes: Lagunea is not responsible for venue or cast changes after your booking. No refunds will be given in such cases.

Additional Conditions:
Cancellations must be requested by email to support@lagunea.co before 15:00 (3 PM) on a working day.
All timescales refer to working days (Monday–Friday).
No refunds once an activity has commenced or for services already utilized.
In case of bad weather, if the vendor cancels, you receive a full refund. If the activity proceeds and you decide not to attend, the last-minute cancellation policy applies.
If you are a “No Show” or arrive late, no refunds apply.
Certain tickets (e.g., museums, waterparks, special events) are non-refundable.
Refund processing may take up to 21 working days.
If Lagunea or the vendor cancels an activity, you may choose an equivalent alternative or receive a 100% refund of the amount paid, unless the cause is due to force majeure or unforeseen circumstances.
Refund requests must be received within 28 days of the cancellation date.
Lagunea is not responsible for losses arising from cruise line delays, missed flights, docking changes, or other third-party issues outside its control. Such losses should be reported to your travel insurance provider.
17.1 No Liability for Third Parties: Lagunea serves as a booking agent and is not liable for any act or omission of a vendor or third party.
17.2 Indemnification: You agree to indemnify and hold Lagunea, its officers, employees, and agents harmless from any claims, damages, or expenses arising from your misuse of the Site, breach of these Terms, or misconduct.
17.3 Insurance: Lagunea strongly recommends that you obtain travel insurance covering trip cancellations, medical expenses, personal accident, personal baggage, and other travel-related risks.

18.2 Mauritian Jurisdiction: If a resolution cannot be found, the dispute shall be subject to Mauritian law. The Mauritian courts have exclusive jurisdiction.

Payment to suppliers is based on net rates or agreed commission.
Invoices will be billed in local currency unless otherwise agreed.
Payment is typically via bank transfer within 15 business days following the activity date.
19.2 Prices & Rates:
Suppliers must provide at least 10 business days notice of rate changes.
Bookings made prior to the new rates will be honored at the previously agreed rates.
19.3 Exchange Rates:
All rates quoted between Lagunea and the supplier are confidential.
Lagunea does not guarantee currency conversion rates.
Lagunea reserves the right to adjust rates if exchange rate fluctuations are significant.
19.4 Force Majeure for Suppliers:
If a product or service deviates from its advertised inclusions due to unforeseen circumstances, the supplier shall endeavor to offer equivalent alternatives.
19.5 Communications:
All updates, corrections, or changes must be communicated in writing.
Suppliers must inform Lagunea within 24 hours of any changes affecting a booking.
Lagunea reserves the right to update or modify these Terms at any time without prior notice. Such changes shall be effective immediately upon posting on the Site. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
